California's Three Strike sentencing law in its application has
resulted in
a travesty of justice in that over 400 people in California's
Department of
corrections have been sentenced to Life imprisonment for having done
nothing but shoplift food from a grocery store. This law mainly
victimizes
the poor classes in California who are often forced to steal food to
feed
themselves. In fact you can get a life sentence in the state of
California
and never have committed a violent crime. All one has to do is to
commit
two residential burglaries with the home owner present in the House,
and
then for his third charge all he has to do is steal a sandwich from a
liquor store, and be arrested and incarcerated for having had a petty
theft
with a prior which is a felony offense. Thus he is consigned to a
sentence
of twenty five years to life in prison which is essentially a never
ending
debtors prison based "poor house."


California's Three Strikes Law was passed in 1994 under the
administration
of governor Pete Wilson who was also associated with Prop. 187 infamy
related fame while in office. The law was passed after Richard Allen
Davis
was charged with Capitol Murder in the Killing of the 12 year old
Girl,
Polly Klaus, whose body was found out at Los Guilocos road here in
Santa
Rosa. Now many of our State legislators thought that they were making
us
Californians safe from violent criminals. However, a good portion of
the
victims of the Three Strikes law were non violent offenders. The
inequity
of the law allowed a loop hole to be created whereby someone got 25
years
to life without ever committing a violent crime. This loop hole must
be
closed and the Law amended so that only three violent strike related
offenses merits a sentence of 25 years to life.


Reforming California's Three Strikes law will add a key component of
Reform
and rehabilitation ethic to our state sentencing laws. Already the
Budget
for Rehabilitation programs in our prisons have been slashed by 75%.
All we
do for our State's inmate population is just warehouse them. There is
no
program for rehabilitation or reform, only opportunities to hone
criminal
behaviors which creates a never ending revolving door for
California's
convicts. Obviously the law in the Convict's eyes is one of where
justice
services the wealthy propertied classes and for him he only receives
the
blunt end of the stick, since his relative state of poverty dictates
his
criminal recidavist activities. The fact is all crime is a function
of
static class mobility. The poor are given a smaller pool of resources
than
the rich even though they are are the majority leaving no other
alternative
but for there to be conflict and strife among the upper and lower
classes.
Tensions are further inflamed when unjust laws are passed that
disproportinately and unfairly target the poor and powerless who are
unable
to change their economic circumstances.


California's Three Strikes law is up for Amending in this 2012
election
cycle. Voters should elect to change the law so that only violent
offenders
receive 25 year to life sentences.
